You can deem a driver eligible to claim the Adverse Driving Exemption in the case of unforeseen traffic or weather conditions as described in §395.1(b). Claiming this exemption has the following effects:

Increases the Drive limit clock by 2 hours, from 11 to 13 for Property drivers or from 10 to 12 for Passenger drivers.

Increases the Shift limit by 2 hours, from 14 to 16 for Property drivers and from 15 to 17 for Passenger drivers. Please note, this exemption is only applicable towards Federal Property and Passenger rulesets.

A banner appears on the HOS log to highlight the exemption.

Claimed and unclaimed events will add a remark in the HOS log.
When a driver claims this exemption, they can enter a remark to appear in the log and ELD Data File to provide an explanation to any interested inspector.
